Whereas, pursuant to Ordinance No. 307 otherwise known as the “Traffic Code of Angeles City” particularly Section7.b.1. identified those PUJ's plying within city limits;
Whereas, Section 4 of the same Ordinance creates the Angeles city Traffic Management Board (ACTMB) the policy making body which shall approve guidelines, rules and regulations for the effective implementation of the Traffic Code;
Whereas, for more almost two decades, there was a long unresolved issue as to the number of approved Telabastagan Extension legally issued/given by the Land Transportation and Regulatory Board (LTFRB);
Whereas, the City Government of Angeles recognizes the need to put finality in this long unresolved issue to bring about harmonious relationship between the Villa-Pampang and the Villa- Telabastagan groups;
Whereas, after series of meetings and deliberation, the Angeles City Traffic Management Board issued a resolution declaring the Villa-Telabastagan route as outside city limit;
Whereas, after careful study, there is a need to allow certain number of units from the Villa-Telabastagan to allow entry within the city to accommodate those coming from Telabastagan going to the city proper;
Whereas, there is now a need to amend Section 7.b.1.of Ordinance No. 307, Series of 2012, thus declaring the Villa-Telabastagan as outside city limit route;
Now Therefore, be it ordained by the Sangguniang Panlungsod of the City of Angeles in session assembled, that:
Section 1. Sections 3.o of Ordinance No. 307, Series of 2012 “Traffic Code of Angeles City” is hereby amended, to read as follows:
Section 3. Definition of Terms
3.o “Outside City Limit Vehicles” – Public utility vehicles plying routes outside Angeles City, or plying routes which pass within and outside Angeles City.
Section 2. Section 7.b.1 of Ordinance No. 307, Series of 2012 is likewise amended by excluding the Villa-Pampang Telabastagan Public Utility Jeepneys from the within city limits vehicles to ply in Angeles City.
Section 3. The City Mayor will enter into a Memorandum of Agreement with the Villa-Pampang Telabastagan Driver’s Association to determine the number of units which will be granted authority to traverse within Angeles City during the period wherein outside city limits Public Utility Vehicles are prohibited from entering the jurisdiction of Angeles City. The number of units allowed thru the Memorandum of Agreement to enter the jurisdiction of Angeles City shall be reviewed every three (3) years to determine if the number of units are sufficient to serve the commuting public along the route.
Section 4. All previous issuances, resolutions and ordinances inconsistent herewith are hereby repealed and modified accordingly.
Section 5. This Ordinance shall take effect upon its approval and posting in conspicuous places in Angeles City.
