            WHEREAS, it is the policy of the State under the 1987 Constitution of the Philippines to protect the rights of Persons with Disability (PWDs) and promote their welfare and development;

 

            WHEREAS, it is likewise the policy of the Local Government of Angeles City to uplift the well being of its Persons with Disability;

 

            WHEREAS, to attain the objective of the Local Government, it is not only through the assistance and benefits that would promote the health conditions of the Persons with Disability but also uplift the moral well being  through entertainment;

 

            WHEREAS, the most common available form of entertainment is movies;

 

            WHEREAS, the Persons with Disability of Angeles City must be provided with privileges on top of those provided by RA 9442, amending RA No. 7277, which further expand the privileges of Persons with Disability, to include among others the following:  “twenty percent (20%) discounts on medical and dental services, medicine and medical equipment purchases, entertainment establishments, transport fares, and provisions of express lane in commercial and government establishments.”

 

            WHEREAS, the Sangguniang Panlungsod of Angeles City deems it necessary that granting free admission to Persons with Disability in cinemas or theaters with certain conditions is desirable to attain the noble objectives of the local government;

 

            NOW THEREFORE, Be it ordained, as it is hereby ordained, by the 17th Sangguniang Panlungsod, of Angeles, in session assembled, that:

 

Section 1. Title.  This ordinance shall be known as an Ordinance providing free admission to Persons with Disability of Angeles City in all theaters and cinemas located in Angeles City.

 

Section 2.  Definition of Terms.

  1. Person with Disability – shall mean those suffering from any restriction of different abilities, as a result of a mental, physical, sensory or neurological impairment in performing an activity in the manner or within the range considered normal for a human being.
  2. Theater and Cinema-refer to movie houses promoting or projecting movies locally and internationally produced through the use of projectors and members of NCAP.
  1. Admission Ticket-refers to the admission ticket to be paid to theaters or cinemas by patrons with intent to watch and view the promoted movie.
  2. Blockbuster Movies-those movies that have been referred to as high budgeted production as determined by NCAP.
  3. Children with Disability – persons below eighteen (18) years of age, those over but with mental capacity as that of a child and are unable to fully take care of themselves or protect themselves because of mental retardation, hearing impairments, including blindness, deafness, speech of language impairments, visual impairments, serious emotional disturbances, orthopedic impairments, autism, traumatic brain injury, other health impairments or specific learning disabilities who by reason thereof need special education and other services.

 

Section 3. Coverage.  Filipino citizens with Persons with Disability Identification Cards issued by Office for the Angeles City Office for Persons with Disability Affairs (ACOPDA), Angeles City shall be entitled to free admission by cinema/theater operators in Angeles City.  Any foreign national who present a Filipino Citizenship Card could avail of the privilege.  He/she should appear personally and present his/her valid PWD Identification Card together with the movie booklet before the ticketing counter of the movie theater concerned.

 

Section 4.  Privileges.  Free admission to movies/cinemas can be availed of only on Monday and Tuesday first and second screening/showing only, except when Monday and Tuesday fall on a holiday.

 

            Section 4.1. Children with Disabilities (CWDs) shall be given free access anytime of the day provided they are accompanied by parents or guardians.

 

Section 5.  Restrictions:

 

  1. The privilege under this ordinance cannot be availed of by persons with disability during official and special holidays falling either on Monday or Tuesday, provided, however that privilege for discount given to persons with disability by virtue of RA 9442 shall continue to take effect.
  2. Any movie rated as a blockbuster movie by the National Cinema Association of the Philippines (NCAP) and Metro Manila Film Festival (MMFF) shall be exempted for viewing by the persons with disability during the first seven (7) days of its initial showing.
  3. The privilege shall not include Pay Per View events and 3D Films.

 

Section 6.  Logbook.  The Cinema operators shall make a logbook available to record those who availed of the free admission benefits and shall be required to submit a quarterly report to the Office for the Angeles City Office for Persons with Disability Affairs (ACOPDA), Angeles City.

 

Section 7. Printing of Movie Booklets.  The Angeles City Office for Persons with Disability Affairs (ACOPDA) will be responsible for the printing and issuance of movie booklets wherein the provisions of this ordinance shall be reflected at the last pages of the movie booklets.

 

Section 8.  Violation. Any movie or theater operator found violating or not complying with this ordinance shall be subjected to a fine of Php5,000.00 for each violation and/or imprisonment ranging from one (1) month to six (6) months at the discretion of the court.

 

Section 9.  Repealing Clause. This ordinance supersedes and/or amend any ordinance or resolution found inconsistent therewith.

 

Section 10.  Effectivity. – This ordinance shall take effect upon approval and publication in a newspaper of local circulation.
